Vriends Corp., a California corporation (“Company”), respects your privacy and is
committed to protecting it through our compliance with this privacy policy (“Privacy
Policy”) as may be referred to in other Company documentation, including but not
limited to the Terms of Use).
This Privacy Policy to explain the type of information we may collect and to inform you
of the specific practices and guidelines that protect the security and confidentiality of
personal information, including protected health information (“PHI”) that individually
identifies you or others and that is subject to HIPAA. This Privacy Policy governs your
usage of the Vriends website (https://www.vriends.com/) and mobile application
(collectively the “Platform”) to access our Services (as defined in the Terms of Use).
This Privacy Policy applies to information we collect on the Vriends Platform:
● when you browse the Platform, or
● when you submit a form to create an Account (as defined in the Terms of Use), or
● in text messages, phone calls, emails and other electronic messages between
you and the Company.
It does not apply to information:
● collected by the Company offline or through any other means, including on any
other website operated by the Company or any third party; or
● any third party, including through any application or content that may link to or be
accessible from or on the Vriends Platform.
By using the Platform, you accept and agree to be bound and abide by the
Privacy Policy. Please read this Privacy Policy carefully to understand our policies and
practices regarding your information and how we will handle it. If you do not agree with
our policies and practices, your remedy is to not access and use the Vriends Platform.
This Privacy Policy may change from time to time. We will use our best effort to provide
email notice to any registered users about the changes to our Privacy Policy. Your
continued use of the Vriends Platform after we make changes to our Privacy Policy is
deemed to be the acceptance of those changes, so please check this Privacy Policy
periodically for updates.
1) Children’s Privacy
Vriends Platform is not intended for children under the age of 13. You must be at least
13 years old or older to use our Services. We will not knowingly collect information from
children under the age of 13. If we learn that we have collected or received personal
information from a person under 13, we will delete that information. Additionally, no one
under the age of 18 may provide any personal information to us on the Vriends Platform
without the permission of their parent or guardian. If you are a minor under the age of
18, you will need the permission of your parent or guardian prior to using the Vriends
Platform or to provide us with any information about yourself, including your name,
address, telephone number, email address, or any other information. If you believe your
child has provided us with personal information without your authorization and you
would like to have the personal information deleted, please contact us by emailing
privacy@vriends.com.
Notwithstanding the foregoing, if you are a parent or guardian of a child using the
Vriends Platform for a research-related purposes relating to the Institutional Review
Board (IRB), Vriends will obtain the verifiable consent as required by the Children’s
Online Privacy Protection Rule (COPPA) from you via the signing of a consent form
through DocuSign before the commencement of any Services and before Vriends
collect any information about your child. Vriends will not require your child to disclose
more information than is reasonably necessary to receive the Services. As the parent or
guardian of a child user of the Vriends Platform, you may review your child’s personal
information, delete it, and refuse to allow any further collection or use of your child’s
information by emailing privacy@vriends.com.
2) The Information We Collect
We collect several types of information from and about users of the Vriends, including
the following:
- Personal Information: When you access the Vriends Site or App, we may ask you to
voluntarily provide us with certain information that personally identifies or could be
used to personally identify you (“Personal Information”). Personal Information
includes, but is not limited to, contact information (such as your name, address,
e-mail address and phone number, demographic data (such as your gender, date of
birth and zip code), picture, and medical data and health information you choose to
share. You do not have to provide any of your medical data and health information if
you choose not to provide it. Your written consent is required before Vriends collects
any of your medical data and health information. We may also collect additional
information, which may be Personal Information, as otherwise described to you at
the point of collection or pursuant to your consent.
- Billing, Collection and Payment Information: When you make a payment for a
session, your payment card information may be processed by our payment
processing partner, Stripe. Stripe collects your voluntarily provided payment card
information necessary to process your payment. Stripe’s use and storage of
information it collects is governed by Stripe’s applicable terms of service and
privacy policy. The information we store includes your payment card type and the
last four digits of the payment card. We may provide to you the option to remove
your stored payment card information through your account settings.
- Protected Health Information: Under a federal law called the Health Insurance
Portability and Accountability Act (“HIPAA”), some of the contact, demographic,
payment, and health or healthcare-related information that Vriends collects may be
considered “Protected Health Information” or “PHI.” PHI under HIPAA include
information such as diagnoses, treatment information, medical test results,
prescription information, national identification numbers and demographic
information such as birth dates, gender, ethnicity, and contact and emergency
contact information. HIPAA provides specific protections for the privacy and security
of PHI and restricts how PHI is used and disclosed. Vriends is a covered entity or a
business associate of a covered entity, which must comply with HIPAA regulations.
Vriends will only collect and disclose PHI with your prior written consent. More

- Traffic Data: When using Vriends, we also may automatically collect data including
your IP address, domain server, type of mobile device(s) used to access the
Vriends Platform, web browser(s) used to access the Site, any referring webpage or
other source through which you accessed the Site, geolocation information and
other statistics and information associated with the interaction between your
browser or device and Vriends (collectively called “Traffic Data”). Depending on
applicable law, some Traffic Data may be Personal Information.
3) How We Collect Information
We collect the above-mentioned types of information from you when you provide it to us
when you register to use the Platform and as part of providing some of our Services to
you.
As you navigate through and interact with the Platform, we may use automatic data
collection technologies to collect certain information about your equipment, browsing
actions, and patterns, including details of your usage (including traffic data, location
data, logs, and other communication data), information about your computer and
internet connection (including your IP address, operating system, and browser type) and
behavioral tracking (including online activities over time and across third-party websites
or other online services. We may also collect information that your computer or mobile
device provides to us in connection with your use of the Services
We may also ask you for information when you report a problem with Vriends and retain
records and copies of your correspondence (including email addresses), when you
contact us. Details of any transactions you carry out through Vriends may also be
collected when you provide financial information when placing an order. We may also
collect information you authorize third parties to release to us, such as from our
business partners or Healthcare Providers.
Do Not Track: The term “Do Not Track” refers to a HTTP header offered by certain web
browsers to request that websites refrain from tracking the user. We take no action in
response to Do Not Track requests.
The information we collect automatically does not include Personal Information, but we
may maintain it or associate it with Personal Information we collect in other ways or
receive from third parties. It helps us to improve the Vriends Platform and to deliver
better and more personalized Services by enabling us to estimate our audience size
and usage patterns, store information about your preferences, allowing us to customize
the Vriends Platform according to your preferences and recognize you when you sign in
to Vriends Platform.
The technologies we use for this automatic data collection may include:
● Cookies (or browser Cookies). A cookie is a small file placed on the hard drive of
your computer or mobile device. You may refuse to accept browser Cookies by
activating the appropriate setting on your browser. Unless you have adjusted
your browser setting so that it will refuse Cookies, our system will issue Cookies
when you access the Vriends Platform.
● Flash Cookies. Certain features of our website may use local stored objects (or
Flash cookies) to collect and store information about your preferences and
navigation to, from, and on our website. Flash cookies are not managed by the
same browser settings as are used for browser cookies. For information about

● Web beacons (a.k.a. “clear GIFs” or “Pixel Tags”). Web beacons are tiny graphic
images with a unique identifier, similar in function to Cookies, that are used to
track the online movements of web users. In contrast to Cookies, which are
stored on a computer’s hard drive or web browser, they are embedded invisibly in
web pages. Web beacons also allow us to send email messages in a format that
users can read, and tell us whether emails have been opened to, in part, ensure
that we are sending only messages that are of interest to our users. We may also
use this information to reduce or eliminate messages sent to a user.
4) How We Use Your Information
We use Personal Information you provide to us or we collect from you to provide you
with information relating to the Services that you request from us, to provide you with
notices about your account, including expiration and renewal notices, to carry out our
obligations and enforce our rights arising from any contracts entered into between you
and Vriends, including for billing and collection, to notify you about changes to Vriends
or any products or services we offer or provide through it, to allow you to participate in
interactive features, to customize and tailor your experience, which may include sending
customized messages, or any other purpose with your written consent.
We may use your PHI to provide the Services, to meet our legal obligations, or for any
other purpose for which you have given consent.
We may use information that is neither Personal Information nor PHI (including
information that has been de-identified and aggregated) to better understand who uses
Vriends and how we can deliver a better experience, or otherwise at our discretion.
5) How We Share Your Information
Vriends may use the information that we collect about you or that you provide to us,
including any Personal Information and PHI:
● to present the Vriends Platform and its contents to you,
● to provide you with information or Services that you request from us,
● to fulfill any other purposes for which you provide such information for,
● to enhance the Vriends Platform via with customized and personalized viewing
recommendations for content we think will optimize your experience with the
Vriends Platform,
● to provide you with customized Services and advertising you view,
● to carry out our obligations and enforce our rights arising from any contracts
entered between you and Vriends,
● to notify you about changes to the Platform,
● in any other way we may describe when you provide the information to us,
● for any other purposes with your consent.
Vriends may also share your Personal Information or PHI with another company in
connection with a merger, sale, acquisition or other change of ownership or control by or
of the Company (whether in whole or in part). Should one of these events occur, we will
make reasonable efforts to notify you before your information becomes subject to
different privacy policies and practices.
We will not rent or sell your Personal Information.
Additionally, because you may access the Platform through different devices (e.g., your
mobile phone or computer) and different platforms (e.g., the Website or App). The
information that we collect and store through those different uses may be
cross-referenced and combined.
We may share your Personal Information if we determine in good faith that such
disclosure is needed to comply with any court order, law, or legal process, including to
respond to any government or regulatory request, to prevent or lessen a serious and
imminent threat to the health or safety of you, another person or the public, to enforce or
apply our Terms of Use, including for billing and collection purposes or if we believe
disclosure is necessary or appropriate to protect the rights, property, or safety of
Company, our customers, or others. This includes exchanging information with other
companies and organizations for the purposes of fraud protection and credit risk
reduction.
Third parties and Sponsors that receive your information may or may not have a legal
obligation to keep your personal information private.
6) Choices About How We Use and Disclose Your Information
Vriends strives to provide you with choices regarding the information you provide to us.
Tracking Technologies and Advertising: You may set your browser to refuse all or some
browser cookies, or to alert you when cookies are being sent. To learn how you can
manage your Flash cookie settings, visit the Flash player settings page on Adobe's
website. If you disable or refuse cookies, please note that some parts of the Site may
then be inaccessible or not function properly. Vriends may also make available privacy
settings in the App for you to adjust how we use and disclose your information.
7) Data Security
We use a combination of technical, administrative, and physical controls to maintain the
security of your data. If you have a security-related concern, please contact us
immediately. Always be sure to secure your login credentials for accessing the Platform.
To protect you and your information, we may suspend your use of any of the on-line
service, without notice, pending an investigation, if we suspect any breach of security.
Unfortunately, the transmission of information via the internet is not completely secure.
Although we do our best to protect your Personal Information, we cannot guarantee the
security of your Personal Information transmitted to Vriends. Any transmission of
Personal Information is at your own risk. We are not responsible for circumvention of
any privacy settings or security measures contained on the Platform.
We have implemented measures designed to reasonably secure your Personal
Information from accidental loss and from unauthorized access, use, alteration, and
disclosure.
When you use our Platform there is a risk that your PHI will be stored unencrypted on
your mobile device. We take a variety of technical safeguards to make sure that your
PHI does not leak onto your mobile device but we cannot guarantee that these
safeguards work.
8) Links to Third Party Websites
The Vriends Platform may contain links to third party websites and services (e.g. Stripe
for payment processing) and some of those third-party websites may be co-branded
with our logo (“Third-Party Services”). These Third-Party Services are not our
services. We do not control (and are not responsible for) third party content or privacy
practices. Any personal information you provide to them is not covered by this Privacy
Policy. We encourage you to review carefully the legal and privacy policies of all other
digital services that you visit.
9) Changes to Your Information
All users may review, update, correct or delete the Personal Information in their user
account by contacting us at privacy@vriends.com. If you completely delete all of your
information with us, then your user account will be deactivated. We may retain an
archived copy of your records.
10)Data Retention and Account Termination
You may close your Account by clicking here or in “settings” on the Platform. We
may terminate your account after six (6) months of inactivity. After the
termination of your account, we may retain information about you for the
purposes authorized under this Privacy Policy unless prohibited by law. For
example, we may retain information to prevent, investigate, or identify
possible wrongdoing in connection with the Services or to comply with legal
obligations. We may also maintain residual copies of your Personal
Information in our backup systems.
11) Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page with a
notice that the privacy policy has been updated on the Site home page. If we make
material changes to how we treat our users’ Personal Information, we will notify you by
email to the email address specified in your account or through a notice on our Vriends
home page. You are responsible for ensuring we have an up-to-date active and
deliverable email address for you to receive such notices.
12)California Privacy Rights
If you are a resident of California, this privacy policy is supplemented by our Privacy
Notice for California Residents explaining your privacy rights and how affected parties
can exercise those rights.
13)EU/EEA/UK Privacy Rights
If you are located in the European Union, European Economic Area, or the United
Kingdom, this privacy policy is supplemented by our EU, EEA, and UK Privacy Notice
explaining your privacy rights and how you make exercise these rights as well as other
issues.
